<br />AGENCY NAME Water Conservation Board <br /> <br />AGENCY NUMBER PDA <br /> <br />ROUTING NUMBER <br /> <br />Cfb02ff <br /> <br />CON T RAe TAM END MEN T #1 <br /> <br />THIS AMENDMENT, made this ~tk day of Nodi'rV\6v,l' 1995, by and between the <br />state of colorado for the use and benefit of the Department of Natural Resources, Colorado <br />Water conservation soard (CWCS), hereinafter referred to as the STATE, and the SANTA MARIA <br />RESERVOIR COMPANY, P. O. BOX 288, Monte Vista, Colorado 81144, hereinafter referred to as <br />the CONTRACTOR. <br /> <br />REelT ALS <br /> <br />1. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for payment <br />in Fund Number 424, Appropriation Code 378, Contract Encumbrance Number C153533; and <br /> <br />2. Required approval, clearance, and coordination has been accomplished from and with <br />appropriate agencies; and <br /> <br />3. The STATE and the CONTRACTOR entered into a contract dated May 8, 1989, Contract <br />Routing Number 89295, contract Encumbrance Number C153533, hereinafter referred to as <br />ORIGINAL CONTRACT, wherein the STATE agreed to loan money in the total amount of 5454,000, and <br />the CONTRACTOR agreed to repay the loan in accordance with the terms of the ORIGINAL CONTRACT; <br />and <br /> <br />4. The CONTRACTOR submitted a letter dated January 5, 1994, attached hereto and identified <br />as ATTACHMENT A, requesting a one year deferral of the June 1994 payment of Contract <br />#C153533 in the amount of $29,532.71 in order to help finance a feasibility study; and <br /> <br />5. At the meeting of January 19, 1994, the Board agreed to defer the payment one year, <br />thus extending the term of the loan by one year so that the final loan payment would be made <br />June 2021 instead of June 2020. <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments <br />which shall be made pursuant to this Amendment and ORIGINAL CONTRACT and the promises and <br />agreements herein set forth. <br /> <br />2. It is expressly agreed by the parties that this Amendment is supplemental to the ORIGINAL <br />CONTRACT which is identified as ATTACHMENT B, and is incorporated herein, and all terms, <br />conditions, and provisions thereof, unless specifically modified herein, are to apply to this <br />Amendment as though they were expressly rewritten, incorporated, and included herein. <br /> <br />SANTA MARIA RESERVOIR COMPANY <br /> <br />Page 1 of 2 <br /> <br />CONTRACT AMENDMENT #1 <br /> <br />, <br /> <br />., <br />.; <br />
