The Contractor warrants that in the event of a default by the Contractor in the repayment to the State, and upon written notice thereof from the State, the Contractor shall, pursuant to applicable law, immediately take all necessary actions allowed by law to raise additional revenues in a sufficient amount and in a timely manner to cure the default and to repay the State as required by the contract. N. The Contractor agrees that pursuant to its statutory authority, it shall adjust revenues from water user fees from time to time as necessary to provide for adequate management, operation and maintenance of the Project to assure its ability to make repayment of the loan under this Contract O. The Contractor hereby pledges sufficient annual revenues to pay the annual installment amount [to be kept in a separate account] subject only to the pledge of funds for repayment of the District's Water Revenue Refunding Bonds, Series 1987. P. The Contractor warrants that by acceptance of the loan money pursuant to the terms of this contract and by the Contractor's representation herein, the Contractor shall be estopped from asserting for any reason that it is not authorized or obligated to repay the loan money to the State as required by this contract. Q. This contract requires review and approval of plans, specification, and various other technical and legal documents. The State's review of these documents is only for the purpose of verifying contractors compliance with this contract and shall not be construed or interpreted as a technical review or approval of the actual design or construction of the Project. Notwithstanding any consents or approvals given contractor by the State on any such documents, Contractor and its Consultant preparing any such documents shall be solely responsible for the accuracy and completeness of any of the construction documents. R. No monies will become available from this contract unless an equal amount is made available by the Contractor, as the equal cost -share for the project. S.
