Con'ract Encumbrance Number, C.J!5 3t. 10 ; and <br /> <br />WHEREAS, required approval, clearance and coordination have been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisions of 37-60-119 and 37-60-120, Colorado Revised <br />Statutes, the State is authorized to loan money for the construction of water projects for the <br />benefit of the people of the State provided that the Contractor assures repayment of that <br />money; and <br /> <br />WHEREAS, the Ute Water Conservancy District is a Water Conservancy District in <br />the State of Colorado created and operated pursuant to Article 45, Title 37, c.R.S.; <br /> <br />WHEREAS, the Contractor wishes to reconstruct its Colorado River Pump Station <br />facilities as the first phase of the Plateau Creek pipeline project, hereinafter sometimes <br />called the project, for the benefit of the members of the Ute Water Conservancy District <br />in Mesa County, Colorado, at an estimated cost of Eight Hundred Thousand Dollars <br />($800,000); and <br /> <br />WHEREAS, the State now desires by this project contract to loan money for the <br />construction of said project upon mutually agreeable terms and conditions, subject to the <br />availability of funding for that purpose; and <br /> <br />WHEREAS, pursuant to Article 45, Title 37, c.R.S., the Contractor has authority to <br />contract to borrow money provided that a Resolution be duly passed by both Board of <br />Directors and to fix and charge rates, fees, and other charges for water sold and delivered <br />by Contractor, which rates, fees, and other charges can be used for repayment of the State <br /> <br />Page 1 of 11 pages <br />
