WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient
unencumbered balance thereof remains available for payment in Fund Number ~ Organization yyyy . Appropriation~/7
Program WfRC. Object Code 5120. Con'ract Encumbrance Number, C.J!5 3t. 10 ; and

WHEREAS, required approval, clearance and coordination have been accomplished from and with appropriate agencies; and

WHEREAS, pursuant to the provisions of 37-60-119 and 37-60-120, Colorado Revised
Statutes, the State is authorized to loan money for the construction of water projects for the
benefit of the people of the State provided that the Contractor assures repayment of that
money; and

WHEREAS, the Ute Water Conservancy District is a Water Conservancy District in
the State of Colorado created and operated pursuant to Article 45, Title 37, c.R.S.;

WHEREAS, the Contractor wishes to reconstruct its Colorado River Pump Station
facilities as the first phase of the Plateau Creek pipeline project, hereinafter sometimes
called the project, for the benefit of the members of the Ute Water Conservancy District
in Mesa County, Colorado, at an estimated cost of Eight Hundred Thousand Dollars
($800,000); and

WHEREAS, the State now desires by this project contract to loan money for the
construction of said project upon mutually agreeable terms and conditions, subject to the
availability of funding for that purpose; and

WHEREAS, pursuant to Article 45, Title 37, c.R.S., the Contractor has authority to
contract to borrow money provided that a Resolution be duly passed by both Board of
Directors and to fix and charge rates, fees, and other charges for water sold and delivered
by Contractor, which rates, fees, and other charges can be used for repayment of the State
