Burlington & Ouincy Pipeline. This water right is an extremely small <br />direct flow right. The initial appropriation was for .15 cfs. Originally, 0.0214 cJ's <br />were used for domestic and irrigation purposes and 0.1286 cfs were used for <br />consumptive power purposes in connection with a railroad operation. The Town <br />of Lyons acquired the 0.1286 cfs industrial right, but has not changed the right to <br />municipal use. <br /> <br />2. St. Vrain & Palmerton Ditch. The St. Vrain & Palmerton Ditch is owned by a <br />mutual ditch company. The water rights were originally adjudicated as direct flow <br />rights for irrigation purposes. Lyons has acquired 1.5 shares of stock in the SI:. <br />Vrain & Palmerton Ditch Company. However, the Town has not changed its pro <br />rata share of the water rights to municipal use. At this time, there has been no <br />historic consumptive use analysis of the Town's shares. Based on previous cas(~s <br />involving changes of St. Vrain & Palmerton Ditch water rights to municipal usei;, <br />1.5 shares would typically yield 36.9 acre-feet of annual yield. <br /> <br />3. Button Rock Reservoir. Lyons is entitled to the first 300 acre-feet of the senior <br />storage right in the reservoir. Lyons also has carry-over rights up to a total 300 <br />acre-feet cap comprised of carry-over water and water stored in priority. <br />Additionally, the water commissioner has run an undecreed exchange up to the <br />Button Rock Reservoir 300 acre-foot pool using the Town's 523 CB-T units as the <br />source of supply. It is believed that most, if not all, of the Town's 523 CB-T units <br />were exchanged up to Button Rock Reservoir prior to the Colorado Wat(~r <br />Conservation Board's filing for in-stream flow rights in the North Fork of <br />St. Vrain Creek. <br /> <br />The Town will be undertaking within the near future an engineering study to determine <br />the firm annual yield of its water rights portfolio, and to determine whether it will be necessary <br />for Lyons to acquire additional water supplies and storage to provide for its future water demand:;. <br />Based upon the results of the study, the Town will undertake such Water Court adjudications, <br />water rights purchases, and/or water agreements as may be appropriate. <br />
