<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />BYLAWS OF <br />ARKANSAS GROUNDWATER USERS ASSOCIATION <br /> <br />The following Bylaws of the Arkansas Groundwater Users Association (AGUA) have <br />been adopted by the Board of Directors as of March 17, 1994. <br /> <br />ARTICLE I <br />OFFICES <br /> <br />The principle offices of AGUA in the State of Colorado shall be located in the town of <br />Manzanola, County of Otero. AGUA may have other offices, either within or without the State <br />of Colorado, as the Board of Directors may designate. <br /> <br />The registered office and registered agent of AGUA may be changed from time to time <br />by the Board of Directors in accordance with the laws of the State of Colorado. <br /> <br />ARTICLE II <br />MEMBERS <br /> <br />1. Application for membership shall be made upon application forms as approved by <br />the Board of Directors. All applications for membership shall be subject to approval or rejection <br />by the Board of Directors. Prospective members shall be admitted or denied membership upon <br />such rules, and upon payment of such fees, as may be determined from time to time by the <br />Board of Directors. The Board of Directors, however, shall not be required to adopt rules <br />governing membership and may act in the absence of such rules. The acceptance into AGUA <br />in no way implies that the member well is ensured the ability to pump free of lawful restrictions <br />imposed on all well owners. All members share equally in whatever benefits AGUA can make <br />available in the way of well augmentation. <br /> <br />2. AGUA may agree to a reduction or waiver of dues and assessments if the applicant <br />assigns to AGUA sufficient water or water rights as may be required to meet lawful requirements <br />for said applicant's wells. <br /> <br />3. Conditions for membership: <br />a. Payment of dues and or assessments <br />b. Submission of well test results, or authorization to conduct well testing as set <br />out in section 4. <br />c. Reclamation Reform Act Certificate of Holdings (if applicable). <br />d. Authorization for access to electrical records or an agreement to keep and <br />supply said records to AGUA. <br />e. If well is powered by sources other than electricity, a yearly statement of fuel <br />consumption (gas, diesel, etc.) shall be submitted to AGUA. <br /> <br />1 <br />
