Water from Pueblo is available on a monthly basis as needed by AGUA.

Appropriate transit losses are applied on all water released from Pueblo's Upper Arkansas River

sources to Reach 1, which begins at the Fountain Creek confluence, to determine replacement credits.

Transit losses from high mountain storage to Pueblo reduces available replacement credits to AGUA

by 9.57 percent for replacements below Pueblo Reservoir, and by 6 percent for replacements between

Salida and Pueblo Reservoir.

By agreement with the owner, AGUA also has the right to utilize up to 50 acre-feet of transmountain
water leased from the Board of Water Works of Pueblo by Owl Canyon LLC for the Chico Creek Dairy
wells. Because there will be less than 0.01 acre-feet of lagged replacement requirement for the dairy
during the 1997 plan year, AGUA will have the entire 50 acre-feet available for its replacement.

Water purchased from the Board of Water Works of Pueblo is used to offset the projected 122 acre-
foot depletion to the Arkansas River above Pueblo Reservoir, and a portion of the projected 6,853
acre-foot depletion to the Arkansas River between Pueblo Reservoir and John Martin Reservoir.

C. Southeastern Colorado Water Conservancv District Sources

AGUA has purchased Fryingpan-Arkansas (Fry-Ark) Project return flow water from the Southeastern

Colorado Water Conservancy District (SECWCD) for plan year 1997. AGUA has requested 1,000

acre-feet of Fry-Ark return flows on the main stem of the Arkansas River, and 375 acre-feet (reduced

from 600 acre-feet as shown in the RMC, March 1997 report) of Fry-Ark return flow water on Fountain

Creek. The 1,000 acre-feet of return flows is being used to replace a portion of the 6,853 acre-foot

depletion on the Arkansas River below Pueblo Reservoir. The 375 acre-feet of Fry-Ark return flow

credits accrue to Fountain Creek year-round and are used to replace a portion of the 629 acre-foot

depletion on Fountain Creek. On November 15, 1997, unused return flows sufficient to replace

depletions accruing during the 1997/1998 winter storage season, will be booked over to the

undistributed winter storage account.

-10-
