IV-2

water available. A senior appropriator, one with an early date, whose

right is not satisfied by the flow at the headgate may call for water that

is being diverted upstream under a junior right. A call upon the junior

is made through the water commissioner who can order the junior to shut

its headgate or who can physically close the headgate himself. This ad-

ministration of water rights is actively carried out on the plains east

of Longmont, and the effect of this administration extends up into the

mountainous area west of Longffiont including Willow and Rock Creeks and

the Al1enspark area.

LEGAL AVAILABILITY

Within the Willow and Rock Creek basins, there are few existing water
rights. A review of the files of the State Engineer's Office in Denver
and the District Court in Greeley indicated only three water rights within
the basin. These rights are in Table IV-A.

TABLE IV-A
WILLOW CREEK WATER RIGHTS

1973 SEO
Tab No.
2620

Name
Speer Water Line
Wi ldwood No. 1
Wi ldwood No. 3
Wi ldwood No. 4
A = Absolute

Ad' .
Amount Date
0.40 CFS 7-23-51
0.295 CFS 7-13-73
2.50 CFS 8-13-73
2.50 CFS 8-13-73
C = Conditional

Approp.
Date
7-1-30
7-1-28
4-24-67
4-24-67

Status *
A
A
C
C

*

It is our understanding that the Allenspark Water District will purchase

the Speer Water Line when the finances become available. In the meantime,

an informal agreement exists whereby the District uses this particular

water right for its purposes.

The Wildwood Nos. 2,3, and 4 Ditches are under the control of the Triple

Creek Ranch. These rights however are junior to the Speer Water Line and

are subject to calls from the Speer Water Line. The District should mon-

itor and be prepared to protest any petitions by the Triple Creek Ranch

to expand the usage of these rights or transfer new senior rights to

Willow Creek. Such a transfer would weaken considerably the water rights

position of Allenspark.
