A senior appropriator, one with an early date, whose <br /> <br /> <br />right is not satisfied by the flow at the headgate may call for water that <br /> <br /> <br />is being diverted upstream under a junior right. A call upon the junior <br /> <br /> <br />is made through the water commissioner who can order the junior to shut <br /> <br /> <br />its headgate or who can physically close the headgate himself. This ad- <br /> <br /> <br />ministration of water rights is actively carried out on the plains east <br /> <br /> <br />of Longmont, and the effect of this administration extends up into the <br /> <br /> <br />mountainous area west of Longffiont including Willow and Rock Creeks and <br /> <br /> <br />the Al1enspark area. <br /> <br />LEGAL AVAILABILITY <br /> <br />Within the Willow and Rock Creek basins, there are few existing water <br />rights. A review of the files of the State Engineer's Office in Denver <br />and the District Court in Greeley indicated only three water rights within <br />the basin. In the meantime, <br /> <br /> <br />an informal agreement exists whereby the District uses this particular <br /> <br /> <br />water right for its purposes. <br /> <br />The Wildwood Nos. 2,3, and 4 Ditches are under the control of the Triple <br /> <br /> <br />Creek Ranch. These rights however are junior to the Speer Water Line and <br /> <br /> <br />are subject to calls from the Speer Water Line. The District should mon- <br /> <br /> <br />itor and be prepared to protest any petitions by the Triple Creek Ranch <br /> <br /> <br />to expand the usage of these rights or transfer new senior rights to <br /> <br /> <br />Willow Creek. Such a transfer would weaken considerably the water rights <br /> <br /> <br />position of Allenspark. <br />
