<br />b) the second release generally benefitting <br />those middle-ranking direct flow rights <br />diverting water when the River flow is <br />estimated by- the Board to be at its <br />mid-stage in the declining hydrograph, <br />and <br /> <br />.c} <br /> <br />the third relea~e generally benefitting <br />those senior direct flow rights drawing <br />water when the River flow is estimated <br />by the B9~rd to be at its low flow stage <br />in the declining hydrograph. <br /> <br />---.. <br /> <br />Provided, however, that any Compact Waters not released by <br /> <br />the direct flow beneficiaries within the year following its <br /> <br />impoundment shal.l pass to the Owners' storage account in the <br /> <br />Reservoirs. <br /> <br />5.. The right of. the Owners of the Pre-Compact Reservoirs <br /> <br />to first use of such Reservoirs' capacity for storage of <br /> <br />waters impounded under their own decrees is acknowledged to <br /> <br />be paramount. The right to store Compact waters at the <br /> <br />Pre-Compact Reservoirs is subordinate to the prior rights of <br /> <br />the Owners to utilize their respective reservoirs' capacity. <br /> <br />To this end, Compact Waters, including water relinquished by <br /> <br />the State Engineer to direct flow users on the Rio. Grande <br /> <br />mainstem shall be deemed to overlay waters of the Owners, <br /> <br />and shall be deemed the first water spilled from the Reservoirs, <br /> <br />or the first water evacuated from the Reservoirs should <br /> <br />evacuation be necessary for public safety. <br /> <br />6. The Owners shall bear the ordinary costs of operation <br /> <br />and maintenance of the Reservoirs. <br /> <br />7. The Owners shall operate the Reservoirs. The <br /> <br />Owners shall cooperate with the water commissioner for <br /> <br />Former Water District 20 in maintaining appropriate records <br /> <br />of Compact Waters, including those rel-inquished for beneficial <br /> <br />,uses in Colorado, pursuant to this Agreement. <br /> <br />8. When Compact water is released from Pre-Compact <br /> <br />Reservoirs, for beneficial uses in Colorado, such water <br /> <br />shall be deducted from the measured flow at the Del Norte <br /> <br />- 4 - <br />
