<br />" <br /> <br />be delivered at the Colorado-New Mexico state line towards <br /> <br />the satisfacti~n of obligations of the State of Colorado <br /> <br />under Article III of the Rio Grande Compact, C.R.S. 1973 <br /> <br /> <br />S "37-66-101. Waters placed in storage by the State Engineer <br /> <br />pur~uant t? this agreement are hereafter referred to as <br /> <br />_~Gompact .Waters.." <br /> <br />, '- <br /> <br />2. Control of Compact Waters <br /> <br />Compact Waters shall be held in storage by the <br /> <br />District subject to the direction and control of the State <br /> <br />~ogineer during the year such waters are impounded. The <br /> <br />State Engineer may determine.in such year that Compact <br /> <br />Waters are required for delivery at the Colorado~New Mexico <br /> <br />state line in order to meet Colorado's obligations as set <br /> <br />forth in Article III of .the Rio Grande Compact under the <br /> <br />Compact and Stay. If the State Engineer determines that <br /> <br />Compact Waters are needed to fulfill Colorado's obligations <br /> <br />under the Compact and Stay, the District shall forthwith <br /> <br />release Compact Waters in the amounts and at the rates of <br /> <br />flow directed by the State Engi~eer. If the State Engineer <br /> <br />determines that Compact waters are not required for interstate <br /> <br />delivery, he shall by written notice to the District and the <br /> <br />Rio Grande Water Users Association relinquish control of the <br /> <br />Gompact Waters to beneficial uses in Colorado in accordance <br /> <br />with the plan of distribution later provided for in this <br /> <br />Agreement". Compact Water.s for which the State Engineer has <br /> <br />made no order of release or relinquishment by December 31 of <br /> <br />any year shall automatically be deemed relinquished for <br /> <br />beneficial .uses in Colorado in the following year in accordance <br /> <br />with the plan of distribution. <br /> <br />3. Plan of Distribution <br /> <br />The plan of distribution of Compact Waters relinquished <br /> <br />for use in Colorado shall be as follows: <br /> <br />(a) one-half of the Compact Waters shall <br />on relinquishment pass to the District <br />for its use or disposition; <br /> <br />- 3 - <br />
