RECHTAl..S <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencurnbered balance thereof rernains available for <br />payment in Fund Number 424 Organization YYYY, Appropriation V98, GBL DMUS, <br />Program WTRC, -Object Code 5120, Reporting Category 3844, Contract Encumbrance <br />Number C153844 <br /> <br />B. Required approval, clearance, and coordineltion have been accomplished from and with <br />appropriate agencies. <br /> <br />C. Section 37-60-121 (1)(b)(IV), C.R.S., authorizes the STATE to rnake grants from the CWCB <br />Construction Fund with specific authorization from the General Assembly. Section 37-60- <br />115(3), C.R.S. authorizes and directs the STATE to study the state's ground water resource, <br />particularly nontributary water. <br /> <br />D. The CONTRACTOR is coordinating a geo-hydrologic investigation of the Denver Basin <br />aquifers ("STUDY"), which will consist of drilling and coring a 2000 foot research well in the <br />Denver Basin aquifers near Kiowa in the central Denver Basin and conducting a geo- <br />hydrologic analysis of the core and core hole and other analyses. Participants in the STUDY <br />include the U.S. Geological Survey ("USGS"), the Colorado Division of Water Resources <br />("DWR"), and the National Science Foundation ("NSF"). The USGS will store the core, <br />assist in hydrologic core analyses and aquifer testing, and publish a report on the <br />hydrologic aspects of the STUDY. <br /> <br />E. The CONTRACTOR applied to the STATE for a grant from the CWCB Construction Fund to <br />finance a portion of STUDY costs. At its January 1998 meeting, the CWCB approved a <br />Construction Fund grant in the amount of $90,000 to be used for participation in the STUDY <br />with the CONTRACTOR, the USGS and other water users, which grant would be used to <br />match two dollars for every one dollar contributed to the STUDY by any Colorado water user <br />group or agency. The CWCB conditioned disbursement of the grant funds on the <br />CONTRACTOR'S receipt of NSF funds. <br /> <br />Page 1 of 6 <br />
