Box 8, Limon, Colorado 80208, <br /> <br />hereinafter referred to as the contractor, <br /> <br />"IJV) <br />'(3 ~ <br />19-R, by and between the <br />Resources <br /> <br />WUEREAS. authority exists in the Law and Funds have been budgeted. appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available fOf payment in Fund Number 4008 <br />G/L Account Number 576 6X. Contract Encumbrance NumberC15 3317; and <br />ABL Account Number 17660, Qrg. Unit 77-77-777, <br />WHEREAS, re(Juired approval. clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br /> <br />WHEREAS, the State and the Contractor did on September 1, <br />1979, enter into a contract and on January 15, 1980, enter into <br />an amended contract for the construction of a water supply system <br />for the Town of Limon, Colorado at estimated cost of Four Hundred <br />Fifty Thousand Dollars ($450,000) and Seven Hundred Fifty <br />Thousand Dollars ($750,000), respectively, and the amended <br />contract of January 15, 1980, is attached hereto as Exhibit A and <br />hereby incorporated into this amended contract; and <br /> <br />WHEREAS, the State and the Contractor have further agreed to <br />amend the amended contract to include additional portions of the <br />project that were constructed with the Seven Hundred Fifty <br />Thousand Dollars {$750,000); <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent <br />covenants herein contained, it is agreed by the parties hereto as <br />follows: <br /> <br />la The Contractor shall comply with Construction Fund <br />Program Procedures.attached hereto as Schedule A. <br /> <br />2. The terms and provisions of that' certain amended <br />contract dated January 15, 1980, attached hereto as Exhibit A and <br />incorporated herein by reference, remaining in full force and <br />effect except as amended ~erein. <br /> <br />3. Paragraph Aa2a is hereby amended to read as follows: <br /> <br />Conveyor cause title to be conveyed by deed to the Colorado. <br />Water Conservation Board, Department of Natural Resources, State <br />of ColoradO, the following portions of the proposed project <br />facilities: <br /> <br />a. B-inch diameter 2,948 feet + of PVC line with all <br />appurtenances. <br /> <br />b. 6-inch diameter 13,902 feet + of PVC line with all <br />appurtenances a <br /> <br />c. 4-inch diameter 1,511 feet + of PVC line with all <br />appurtenances. <br /> <br />d. A 2-inch diameter, 57-foot galvanized pipe. <br /> <br />e. A booster station with one 190-gallon-per-minute <br />centrifugal pump with all appurtenances and electrical <br />controls. <br /> <br />f.
