<br />3. Require all Subcontractors to indemnify the State and <br />the Contractor against all liability and loss, and against all <br />claims and actions based upon or arising out of damage or <br />injury, including death, to persons or property caused by or <br />sustained in connection with the performance of any sUbcontract <br />or by conditions created thereby, or based upon a~y violation <br />of any statute, ordinance, or regulation, and the defense of <br />any such claims or actions. <br /> <br />4. Require all Subcontractors to maintain liability <br />insurance in at least the following amounts: <br /> <br />a. For any injury to one person in any single <br />occurrence, the sum of One Hundred Fifty Thousand <br />Dollars ($150,000). <br /> <br />b. For any injury to two or more persons in any <br />single occurrence, the sum 'of Four Hundred Thousand <br />Dollars ($400,000). <br /> <br />Said liability insurance shall name the Contractor and <br />the State as co-insureds. No payments shall be made under this <br />contract unless a copy of a certificate of said liability <br />insurance has been filed with the Colorado Water Conservation <br />Board. <br /> <br />5. Conveyor cause title to be conveyed by warranty deed <br />to the Colorado Water Conservation Board, Department of Natural <br />Resources, State of Colorado, the following portions of the <br />proposed project facilities within thirty (30) days of their <br />completion: <br /> <br />An undivided 50 percent portion of the following: <br /> <br />a. A dam embankment to be constructed over the <br />existing Harper Lake embankment frem approximately the <br />following materials, between stations 0+00 to 24+00: <br /> <br />(1 ) 68,770 + cubic yards of pervious fill. <br />(2) 73.100 + cubic yards of impervious fill. <br />(3 ) 6,800 + cubic yards of gravel bedding. <br />(4) 13,600 + cubic yards of riprap. <br />(5 ) 1,700 + cubic yards of roadbase. <br /> <br />b. A 36-inch CMP Spillway about 45 feet long in the <br />most northeastern corner of the reservoir embankment <br />and about 1380 feet east of 80th Street and 550 feet <br />south of the Hillborough West subdivision. <br /> <br />c. About 650 acre-feet of water storage within the <br />present Harper Lake reservoir, storage to be created <br />by the removal of about 1,080,100 cubic yards of dirt <br />in the Harper reservoir area. <br /> <br />d. About 1700 feet of 36-inch RCP to replace and <br />relocate the existing Louisville lateral around the <br />western shoreline. <br /> <br />e. A pumping station and associated facilities as <br />follows: <br /> <br />(1) Two mixed-flow pumps, 20 horsepower each, of <br />a total capacity of about r7 cfs. <br /> <br />(2) A lS-foot-by-20-foot-sized building to house <br />above-mentioned pumps and other pertinent <br />appurtenances. <br /> <br />f.
