Colorado 80027. <br />hereinafter referred to as the contractor, <br /> <br />WHEREAS. authority existS in the Law and Funds have been bud&cled. appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for pllyment in Fund Number 400 A . <br />elL Account Number c;,? c;dY. Unit 77-77-777, <br />WHEREAS. required appro"al. clearance and coordination has been accomplished (rom and wilh appropriate <br />agencieli; and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-119, <br />Colorado Revised Statutes 1973, as amended, the State is <br />authorized to construct certain water projects for the benefit of <br />the people of the state of Colorado; and <br /> <br />WHEREAS, the city of Louisville has made application to the <br />State for the improvement of its existing facility; and <br /> <br />WHEREAS, the contractor is a city within the State of <br />Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor shall have a feasibility report prepared <br />and directed to the problem of improving the storage facilities <br />of the City of Louisville in accordance with a proposal for a <br />project feasibility report prepared by the consulting engineering <br />firm of Rocky Mountain Consultants Inc. (the Consultant) and <br />approved by the State, received on March 11, 1982, which proposal <br />is attached hereto as Appendix A and made a part of this <br />contract. <br /> <br />2. Fifteen (15) copies of the final report called for in <br />this contract shall be furnished to the State not later than <br />September 1, 1982, unless such time is extended by mutual <br />agreement of the pa~ties hereto in writing. <br /> <br />3. As compensation for the services of the Contractor, the <br />State shall pay to the Contractor the sum of Seventeen Thousand <br />Two Hundred Eighty-One Dollars ($17,281) in the manner following: <br /> <br />a. Sixty percent (60%), to wit, Ten ~housand Three <br />Hundred Si~ty-Eight Dollars and Sixty Cents ($10,368.60) <br />of the total amount due in two (2) monthly installments <br />of Five Thousand One Hundred Eighty-Four Dollars and <br />Thirty Cents ($5,184.30) each, commencing on <br />June 1, 1982. <br /> <br />b. The remaining forty percent (40%), to wi t, Six <br />Thousand Nine Hundred Twelve Dollars and Forty Cents <br />($6,912.40) within forty (40) days following receipt and <br />acceptance of the written report specified in paragraph <br />2 of this contract. <br /> <br />4.
