Commencing tAn (10) days from the date of this I <br />contract and for every month thereafter until Raid <br />project has been (:ompleted. the Contractor shall <br />prepare. with the aSKjlil:ance of the CorlHtJll,ant <br />referred to in paragraph B.2. above. an estimate of <br />the funds reqlJired for project t:onstruction during <br />that month and shall forward said estimate to the <br />State not less than fifteen (15) days prior to the <br />beginning of such month. <br /> <br />b. Upon receipt and approval by the State of such <br />monthly estimate. the State will. within forty (40) <br />days from the receipt of such (!stlmate. pay over to <br />the Contractor the amount of the monthly e~t:imate or <br />SIJch portion thereof as has beerl ap~roved by the State. <br /> <br />c. No payments will be made under 1.llis (:orltract <br />unless and until the project plans and "pecifications <br />referr.ed to in paragraph B.2, above are approved by <br />the State in writing. <br /> <br />d. Project construction costs eligihle for payment by <br />the State shall be limited to the cost of: <br /> <br />(1) Preparing final designs and specifications <br />for the project. <br /> <br />(2) Preparing bid..and construcl:ion contract <br />documents. <br /> <br />(3) Preparing envir.onmental assessment or <br />environmental impact statements. and otherwise <br />complying with the federal Nati()nal Rnvironmental <br />POlicy Act. <br /> <br />(4) Complying with all federal. St.te. and local <br />~e911latory requirements. incllJding the obtaining <br />of all required permits. <br /> <br />(5) Land and wate~ rights acquisitiollH needed for <br />the project. including the necessary appraisals <br />and evaluations. <br /> <br />(6) Fish and wildlife mitigation measures <br />required by federal. State, or local laws and <br />regulations, <br /> <br />(7) Actual construction as called for in the bid <br />documents and jn Change Orders appeoved by the <br />Consultant. the Contractor. the Construction Fiem. <br />and the State. <br /> <br />(8) Rngineering G~rvices for (:onstruction <br />management, including design and construction <br />management for State-approved Change Orders. <br /> <br />(9) Legal services for: <br /> <br />(a) Reviewing (~ngjneering t;ecvices contracts. <br /> <br />(b) Reviewing this (:()ntract. <br /> <br />Page ~ of 10 Pages <br />
