<br />CHAPTER II <br /> <br />THE WATER SUPPLY AND STORAGE COMPANY <br /> <br />! <br /> <br />ORGANIZATION AND AUTHORITY <br /> <br />The Water Supply and Storage Company is a mutual irrigation company. <br />The Company was incorporated August 8, 1892 for a term of existence of <br />20 years, as a successor to the Larimer County Ditch Company, which was <br />organized in 1880. The Company has a history of 87 years' operation. <br /> <br />On December 27, 1911, a special meeting of the stockholders was held <br />to adopt a resolution whereby the Art'i.cles of Incorporation were renewed <br />and the term of existence of the Company was extended for an additional <br />period of 20 years. On January 11, 1933 an annual stockholders' meeting <br />was held, whereby a resolution was passed and adopted that gave the <br />Company perpetual existence. The Company is presently existing under and <br />by virtue of the laws of the State of Colorado. <br /> <br />As stated in the Articles of Incorporation and listed below, the objects <br />and purposes for which said Company was formed and incorporated were, and <br />continue to be,. as follows: <br /> <br />"FIRST - That the corporate name of this company is and shall be, 'THE <br />WATER SUPPLY AND STORAGE COMPANY'. <br /> <br />"SECOND - That the objects for which said company is incorporated are, <br />and shall be, to acquire by every lawful means, an additional supply of <br />water for irrigation for the benefit of the owners of water rights in and <br />from that certain irrigation canal known as the Larimer County Ditch, now <br />owned and controlled by the Larimer County Ditch Company, situated in the <br />counties of Larimer and Weld, and State of Colorado; and among other means <br />for accompl ishing said desired end, to enter upon, prosecute, and maintain, <br />the fol~owing enterprises: <br /> <br />"1st - To acquire and become the owner by purchase, condemnation, <br />or oth;r-Iawfu1 means, all the ditches, water rights, appropriations, <br />franchises, and privileges of the Larimer Water Supply Company, and by <br />means of said ditches, and by extending and further prosecuting the con- <br />struction thereof, and by the construction of new ditches, to take, <br />divert, and appropriate as much as possible of the unappropriated waters <br />of the Grand, Michigan and Laramie Rivers, and streams and waters tribu- <br />tary thereto, and to conduct such water so diverted by means of a system <br />of ditches and dams into the several branches and the ma in stream of the <br />Cache la Poudre River, but not so as to raise the waters thereof above <br />ordinary highwater mark; and to take the said water or an equivalent amount, <br />making due allowance for evaporation and seepage, out again at and through <br />the headgate of the Larimer County Ditch, and into and along the said ditch <br />for distribution among its water-right owners who are or shall become stock- <br />holders in this company. <br />
