The natural stream channel at Moore Creek at latitude 380 31' 22''N and <br />longitude 1080 12' l2"W as the upstream terminus and extending to the <br />BLM Land Boundary at latitude 380 40' l8''N and longitude 108009' <br />09"W as the downstream terminus, being a distance of approximately <br />14.4 miles. This segment can be located on the Camel Back and the <br />Roubideau U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus =NW SW SlO T49NRI2WNMPM <br />UTM 42 68 472N 13 220 7l4E <br />410' East of West Section Line, 1610' North of South Section Line <br />Lower Terminus = NE SE S24 T5lN R12W NMPM <br />UTM 42 84 846N 13 225 726E <br />860' West of East Section Line, 2600' North of South Section Line <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 28, 2004 <br /> <br />7. The water was first applied to the above beneficial use on January 28, 2004, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Insteam flow of21.0 cfs (April I <br />- Jun~ 15), 5.0 cfs (June 16 - July 31),1.40 cfs (August I - February 29), and 5.0 cfs <br />(March 1- March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of21.0 cfs <br />(April 1- June 15),5.0 cfs (June 16 - July 31),1.40 cfs (August I - February 29), and 5.0 <br />cfs (March 1- March 31) is hereby entered to preserve the natural environment to a <br />reasonable degree through the stream segment described in paragraph 4 above. The <br />appropriation date for this water right is January 28, 2004. <br />
