The natural stream channel at the BLM-USFS Boundary at latitude 380 <br />31' 58"N and longitude 1080 15' 23"W as the upstream terminus and <br />extending to the confluence with Roubideau Creek at latitude 380 38' <br />18''N and longitude 1 080 II' 40"W as the downstream terminus, being <br />a distance of approximately 9.0 miles. This segment can be located on <br />the Cottonwood Basin, Camel Back and the Roubideau U,S.G.S. <br />quadrangles. <br /> <br />b. For administrative purposes only: <br />Upper Terminus = SW SW 86 T49N R12W NMPM <br />UTM 4269 766N 13 2 16 133E <br />1010' East of West Section Line, 0' South of North Section Line <br />Lower Terminus = SW SE S34 T51N R12W NMPM <br />urn 4281 279N 13 221 957E <br />2300' West of East Section Line, I 160' North of South Section Line <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree, <br /> <br />6. Date of initiation of appropriation: <br />January 28, 2004 <br /> <br />7. The water was first applied to the above beneficial use on January 28, 2004, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10), <br /> <br />8. Amount of water claimed (ABSOLUTE): Insteam flow of 4.0 cfs (April I - <br />June IS), 1.80 cfs (June 16 - July 31),1.0 cfs (August I - February 29), and 1.80 cfs <br />(March 1- March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The applicant is hereby granted an absolute water right in the amount of 4.0 cfs <br />(April 1 - June 15), 1.80 cfs (June 16 - July 31), 1.40 cfs (August I - February 29), and <br />1,80 cfs (March 1- March 31) to preserve the natural environment to a reasonable degree <br />through the stream segment described in paragraph 4 above. The appropriation date for <br />this water right is January 28, 2004, <br />
