It is staffs
opinion that the 12 years of stream-flow data analyzed is representative of average water-years.

Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office to
identify any potential water availability problems. There are no decreed surface diversions within
this reach of stream. Based on this analysis staff has determined that water is available for
appropriation on Cottonwood Creek, from Headwaters to the East Canyon Creek, to preserve the
natural environment to a reasonable degree without limiting or foreclosing the exercise of valid
existing water rights.

CWCB Staffs Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:

SeQment: Slaughter Spring Gulch to Anderson Ditch

Upper Terminus: Slaughter Spring Gulch at
(Latitude 390 32' 11") (Longitude 107002' 15")
Lower Terminus: Anderson Ditch at
(Latitude 390 34' 02") (Longitude 107002' 09")
Counties: Eagle
Length: 2.2 miles
USGS Quad(s): Cottonwood Pass
Flow Recommendation: 1.70 cfs (May 15t - October 31 5t)
1.30 cfs (November 1 st - April 30th)

Cottonwood_Creek_ISF _RPT_ vI.doc

- 5 -
