Existing Water Right Information

Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office
(DEO) to identify any potential water availability problems. There are no decreed surface
diversions within this reach of stream. According to the DEO, the Baxter Creek and Tuttle
Creek Ditches divert water from Ford Creek between Baxter Creek and upper BLM boundary.
These ditches divert under an undecreed transbasin exchange. Water is imported from Division
4 under the Terbell Diversion and exchanged upstream to the Baxter and Tuttle Creek Ditches,
these ditches can and do dry up the creek near Baxter Creek. However, there are several springs
and irrigation return flows do accrue to Ford Creek to provide for the requested ISF on Ford
Creek below the unnamed tributary. The United States Forest Service also has a streamflow
quantification point upstream (QP51R) on Ford Creek for 21.6 cfs. Based on this analysis staff
has determined that water is available for appropriation on Ford Creek, between the Unnamed
Tributary and the BLM Boundary, to preserve the natural environment to a reasonable degree
without limiting or foreclosing the exercise of valid existing water rights.

CWCB Staffs Instream Flow Recommendation
Staff recommends the Board form its intent to appropriate on the following stream reach:

Seament: Unnamed Tributary to BlM Boundary

Upper Terminus: Unnamed Tributary at
(Latitude 380 12' 29") (Longitude 1060 16' 08")
Lower Terminus: BLM Boundary at
(Latitude 380 10' 58") (Longitude 1060 17' 00")
Counties: Saguache
Length: 2.1 miles
USGS Quad(s): Lake Mountain NE
Flow Recommendation: 0.7 cfs (March 1 st - July 31 st)
0.3 cfs (August 1 st - October 31 st)
0.5 cfs (November 1st - February 29th)

Ford_Creek_ISF _RPT_v\.doc

- 7 -
