It is slaffs opinion thai the information contained is this report is sufficient (0 support <br />the findings required in Rule 5.40. <br /> <br />Colorado's Instream Flow Program was crealed in 1973 when the Colorado Slale Legislature <br />recognized ''[he need to correlate the activities of mankind with SOI11C reasonable preservalion of <br />the natural environmen[" (see ~ 37-92-102 (3) c.R.S.). The statue vesls the eWCB with Ihe <br />exclusive to appropriate and acquire instream Ilow and natural lake-level water rights. In order <br />to encourage olher entities 10 participate in Colorado's Instream Flow Program. the statue directs <br />Ihe CWCB to requesl im.lream llow recommendations from other state and federal agencies. The <br />Bureau of Land Management (BLM) recommended this scgmelll of First Anvil Creek to the <br />eweB for inclusion into Ihe Inslream Flow Program. First Anvil Creek is being considered for <br />inclusion into the Instream Flow Program because it has a natural environment that can be <br />presen.ed to a reasonable degree with an instream !low water right. The BL~1 is very interested <br />in protecling the streamJlows in this area because in November of 1997. the U.S. Congress <br />Iransferred management of Ihe Navel Oil Shale Reserve from the Departmenl of Energy 10 the <br />BL~1. Congress directed the BlM 10 manage the area for multiple uses. while simultaneously <br />protecting the area's unique resource values. <br /> <br />First Anvil Creek is a tributary of East Fork Parachute Creek and is approximately 2.3 miles <br />long. It begins Wesl of the Roan Cliffs. at an elevalion of approximately 8600 feet. and <br />terminates al the conlluence ..../ith the Easl Fork Parachute Creek near Rille. at an elevalion of <br />approximalely 8000 feet. It is located completely on federal lands (:\aval Oil Shale Reserve <br />which is managed by the Bureau of land ~1anagemelll). It is located in Garfield County. The <br />lolal drainage area of Firsl Anvil Creek is approximately 2.8 square miles. First Anvil Creek <br />generally flows in a northwesl direction. <br /> <br />The: subject of Ihis report is a 2.3 mile segment of Firsl Anvil Creek beginning at its headwalers <br />and extending downstream to the contluence wilh East Fork Parachute Creek (see Figure I). <br />This ."egmcnt is localed northwest of the City of Rille. To date, staff has received and <br />considered only one tlow recommendation for First Anvil Creek. That recommendation is <br />discu."sed in detail hclow. <br />
