STIPULATION

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF
THE COLORADO WATER CONSERVATION BOARD ON BEHALF OF
THE PEOPLE OF THE STATE OF COLORADO

COMES NOW the Objector, City of Ft. Collins (hereinafter
"Ft. Collins"), by and through its attorneys, Vranesh and Raisch,
and the Applicant, Colorado Water Conservation Board (hereinafter
"CWCB"), by and through the Attorney General, and stipulate as
follows:

l. The CWCB filed the Application in this case on Decem-
ber 2l, 1987.

2. The City of Ft. Collins a Statement of Opposition
dated February 25, 1988.

3. After reviewing information provided by Ft. Collins,
its own files and its other instream flow rights, the CWCB has
determined that the downstream terminus of the requested instream
flow in this case should be moved approximately .6 miles from the
confluence with the West Fork of Sheep Creek to the confluence
with an unnamed tributary as illustrated on the map attached
hereto as Exhibit 1 and as more fully described in paragraph 4 of
the proposed decree attached hereto as Attachment A.

4. This change removes Ft. Collins' concerns over poten-
tial conflicts between the proposed instream flow and its water
rights. Therefore, Ft. Collins will not object to the entry of a
decree which is SUbstantially in the form of, and no less
restrictive than, the proposed decree (Attachment A).
