<br />4. That on October 17, 1979, the undersigned Water Referee <br /> <br />pursuant to C.R.S. 1973, 37-92-303(2) re-referred the case to <br /> <br />the Water Judge. <br /> <br />5. That on October 19,1979, a stipulation was filed 'con- <br /> <br />cerning Applicant and the United States of America, and on May <br /> <br />22, 1980, a stipulation was filed concerning Applicant and the <br /> <br />Southwest Water Company. <br /> <br />6. That on May 29, 1980, the Water Judge entered an Order <br /> <br />Remanding Case to the undersigned ,Water Referee for investiga- <br /> <br />tion and ruling thereon. <br /> <br />7. That the Application herein concerns a claim made pur- <br /> <br />. suant to the provisions of C.R.S. 1973, 37-92~102(3) and C.R.S. <br /> <br />1973, 37-92-103(3), (4) and (10) known as Senate Bill 97, and <br /> <br />that the purpose of the appropriation ,claimed herein by the <br /> <br />State 'of Colorado is to insure the preservation of a minimum <br /> <br />stream level to protect the natural environment to a reasonable <br /> <br />degree. <br /> <br />8.
