4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the headwaters
in the viciri.\ty of latitude 39033' 56"N and
longitude l(iS',,'33',44"W as the upstream terminus
and extending .to"'"Ehe COnfluence of Bear Creek at lati-
tude 39036'48<'N and longitude 10s030'42"W as the down-
stream terminus, being a distanoe of approximately 4.4
miles. This segment can be located on the Harris Park
U.S.G.S. quadrangle.

For the stream segments in an unsurveyed area, the
Division Engineer has qetermined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U.S.F.S mapping is as follows: downstream
terminus in the NE/4 SW/4, Sec. 13, T5S, R73W, 6th
P.M., 2,000 feet East and 1,500 feet North of the
Southwest corner.

5. Use of the water:

Instream flow to prese~ve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 3, 1994.

7. The water was first applied to the above beneficial use
on November 3, 1994, by action of the Colorado Water Conservation
Board under the provision of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), and (10).

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 1.5 c.f.s. (April 1 - October 15); 0.5 c.f.s. (October
16 - March 31) is entered to preserve the natural environment to
a reasonable degree through the upstream and downstream points as
described in paragraph 4 above. The appropriation date for this
water right is November 3, 1994.
