The name ofthe stream involved: <br />Fourmile Creek (instream flow). <br /> <br />3. The source of the water is: <br /> <br />Fourmile Creek, tributary to the Arkan~as River. <br /> <br />Legal description ofthe stream segment through which an instream flow is <br /> <br />a. The natural stream channel from the confluence of High Creek at latitude 380 48' <br />48" N and longitude 1050 15' 27" W as the upstream terminus and extending to the <br />confluence of Cripple Creek at latitude 380 39': 59" N and longitude 1050 13' 42" W as the <br />downstream terminus, being a dIstance of approximately 3.4 miles. This segment can be <br />located on the High Park and Cripple Creek South U.S.G.S. quadrangles. <br /> <br />b. Administration: For the stream segments in an unsurveyed area, the Division <br />Engineer has determined for administrative purposes that theapproximate legal description <br />of the instream flow termini as protracted from U.S.G.S. and/or U.S.F.s. mapping.is as <br />follows: upstream terminus 4,000 feet from the south section line and 1,450 feet from the <br />east section line, in the NW Y4 NE Y4 of Sectiof16, T16S, R70W, 6th P.M.; and downstream <br />terminus 1,600 feet from the south section line and 2,050 feet from the east section line, in <br />theNW Y4SE Y4ofSection 9, Ti6S,R70W, 6th P.M. . <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: January 26, 2000, for 8.2 c.fs. (April 15 - <br />October 14) and 4.1 c.fs. (October 15 -April 14) and September 26,2000, for.8 c.fs. (October 15 <br />- April 14). <br /> <br />7. As to 8.2 c.f.s. (April 15 - October 14) and 4.1 c.f.s. (October 15 - April14), water <br />was first applied to beneficial use on January 26, 2000 and as to .8 c.f.s. (October 15 - April 14), <br />this amount was first applied to beneficial use on September 26, 2000, by action of the Colorado <br />Water Conservation Board under the provision ofC.~.S. 99 37-92-102(3), 37-92-103(3), (4), <br />(10). <br /> <br />2 <br />
