THIS MATTER. having come on before the cOeJrt on the applI-
cation of the Colorado Water Conservation Board and the COurt
being fully advised as to the matter of the appl icatton herein.
hereby makes the following findings:

The application herein was filed with the water clerk.
water Division 4 on May 13.1980. All notices required Dy law
for the filing of this applicatlo, have Deen fulfilled. and tr.e
court has Juri sdiction over the appl ication.

The Uni ted States of Amer iCa timel y filed a statement of
opposition. A stipulation was reached between the United States
and the appl icant herein and such stipulation is made part of and
incorporated into this proposed ruling. the terms of wh,ch are as
follows:

1. Applicant's rights are subject to all senior rights
of the UnIted States of America in the suDJect source. includIng
properly deCreed reserved rights. as are now or will hereafter De
deter~ined Oy law.

2. ApplIcant shall apply for any special use permits or
r i ghts-of- way. as the case may De. if the same are requi red by

appl ication and shall abide by the conditions set forth therein.
