THIS MATTER having come before the court on the application
of the Colorado Water Conservation Board ("CWCB") and the court
being fully advised as to the matter of the application herein,
hereby enters the following Findings of Fact, Conclusions of Law,
Judgment, and Decree.

FINDINGS OF FACT

1989.

1. The above-captioned application was filed on May 31,

2. A statement of opposition was timely filed by Ameri-
can Water Development, Inc. ("AWD").

3. The matter was rereferred to the water judge by Order
of April 20, 1990.

4. The CWCB and AWD executed a stipulated agreement on
September 11, 1990 and August 9, 1990, respectively. That stipu-
lation is attached as Exhibit A and incorporated herein by refer-
ence.
