approving this Instream-Flow right will not injuriously affect
the owner of or persons entitled to use water under a vested
water right.

8. Standards and Burdens of Proof: CWCB has complied with
all requirements, has met all standards and burdens of proof
regarding the Board's appropriation of the Instream Flow rights
requested in this Application, and is therefore entitled to a
Decree confirming and approving its Instream Flow rights as
described more fully in paragraph 4 above.

JUDGMENT AND DECREE

9. Incorporation of Findings of Fact and Conclusions of
Law: The foregoing Findings of Fact and Conclusions of Law are
approved and incorporated herein by reference.

10. Water Right Decreed: It is Ordered that the subject
Application is granted and the following Instream Flow water
right is hereby ordered, adjudged and decreed:

3 c.f.s. ABSOLUTE (~anuary 1 through March 31);
8 c.f.s. ABSOLUTE (April 1 through April 30);
21 c.f.s. ABSOLUTE (May 1 through July 31)
14 c.f.s. ABSOLUTE (August 1 through August 31);
8 c.f.s. ABSOLUTE (September 1 through October 14);
6 c.f.s. ABSOLUTE (October 15 through October 24);
4 c.f.s. ABSOLUTE (October 25 through October 31);
3 c.f.s. ABSOLUTE (November 1 through December 31)

for the purposes of maintaining an Instream Flow to
preserve the natural environment to a reasonable degree
on the North St. Vrain between the upstream and
downstream termini as described above in paragraph 4
with an appropriation date of December 11, 1987.

11. The Applicant shall install and maintain such measuring
devices and maintain such records as the Division Engineer may
require for administration of this Instream Flow right.

12. It is further Ordered that this Judgment and Decree
shall be filed with the ;,'ater Clerk and shall become effective
upon such filing, subject to judicial review pursuant to S 37-92-
304, 15 C.R.S. (1990).

13. It is further Ordered that a copy of this Judgment and
Decree shall be filed with the State Engineer and the Division
Engineer for Water Division No.1.
