The source of the water is: <br /> <br />Bennett Creek, tributary to pinos Creek, a tributary to <br />the Rio Grande. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwaters <br />in the vicinity of latitude 37028'24"N and longitude <br />106027'15"W as the upstream terminus and extending to <br />the confluence of Pinos Creek the SW/4 SE/4, Sec. 29, <br />T39N, R5E, N.M.P.M., as the downstream terminus, being <br />a distance of approximately 8.9 miles. This segment <br />can be located on the Jasper and Horseshoe Mountain <br />U. S.. G. S. quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the NW/4 NW/4, Sec. 9, T37N, R5E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provisions of C.R.S. (1990) !Hl 37-92-102 (3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): <br />3.0 c.f.s.
