Filed: November 13, 1980 <br /> <br />No opposition. has been filed. <br /> <br />FINDING OF FACT <br /> <br />The WEST FORK CEBOLLA CREEK is a natural stream, tributary to <br />the Gunnison River in Hinsdale County and in old Water District <br />No. 62. <br /> <br />Legal description of beginning and end points of minimum <br />st~eam flow claimed:. The natural stream channel from headwaters <br />in vicinity of lat 37056'00" north long 107014'51" west as the <br />upstream terminus and confl East Fork CebolIa Creek lat 37058' 01" <br />north long 107009'58" west as the downstream terminus, being <br />a distance of approximately 6.0 miles. This segment can be <br />located on the Bristol Head 15' U.S.G.S. quadrangle. <br /> <br />Date of initiation of appropriation: September 9, 1980, <br />by final approval of the Colorado Water Conservation Board at <br />its general meeting. <br /> <br />Amount of water claimed: (S - May.l through September 30; <br />W - October 1 through April 30) <br />A. (Stream. only) Flow in C.F.S.: 2 cfs. <br /> <br />This appropriation is made pursuant to the provisions of <br />C.R.S. 1973, 37-92-102(3) and 37-92-103(3)(4) and (10) known as <br />Senate bill 97. The purpose of this appropriation by the state <br />of Colorado is to insure the preservation of a minimum stream <br />level.to protect the natural environment to a reasonable degree. <br /> <br />RULING <br /> <br />IT IS THE RULING OF THE REFEREE that no adverse effect can <br />be determined and that WEST FORK CEBOLLA CREEK, as above described <br />is APPROVED AND GRANTED AN ABSOLUTE IN PLACE DECREE in the amount <br />of 2.0 c.f.s. of water when and if it is available in the natural <br />flow, for the purposes of protecting the natural environment <br />thereof.
