2. The legal description of the structure:

The natural stream channel from the headwaters in the
vicinity of latitude 38004'47" North and longitude
105038'54" West as the upstream terminus and extending to
the confluence with Mill Creek at latitude 38001'54" North
and longitude 105043'18" West as the downstream terminus,
being a distance of approximately 5.7 miles. This segment
can be located on the Rito Alto Peak U.S.G.S. quadrangle.

For administrative purposes only, the Division Engineer has
translated these legal descriptions of the stream termini into
approximate protracted section, township, and range location from
U.S.G.5. mapping as follows: upstream terminus in the 5E/4, NW/4,
sec. 10, T44N, R12E, N.M.P.M.; downstream terminus in the NE/4,
5E/4, sec. 26, T44N, RIIE, N.M.P.M., 1980' FSL, 450' FEL.

5. The amount of water claimed:

Flow in C.F.S.: 3.0 (April 15 through September 30); 1.0
(October 1 through April 14).

To maintain such minimum flows as are required to preserve
the natural environment to a reasonable degree pursuant to
sections 37-92-102 and 103, C.R.S. (1973 & 1988 Supp.). No
diversion of the water right herein will be made from the
natural stream channel.
