Legal description of the stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel from the service boundary of the National Forest <br />at latitude 3So 25' IS" N and longitude 1060 02' 08" W as the upstream <br />tenninus and extending to the confluence of San Luis Creek at latitude 380 <br />25' OS" N and longitude 1060 03' 20" W as the downstream terminus, <br />being a distance of approximately 1.2 miles. This segment can be located on <br />the Poneha Pass U.S.O.S. quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus = NE NW SEC 13 TWN 4SN RNO 8E NMPM <br />2380' East of West Section Line & 100' South of North Section Line <br />UTM, Zone 13, 425281 ON 409599E <br />Lower Terminus = NE NW SEe 14 TWN 4SN RNG BE NMPM <br />1710' East of West Section Line & 950' South of North Section Line <br />UTM, Zone 13, 4252614N 407851 E <br /> <br />5. Use of the water: <br />lnstream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 22, 2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action ofthe Colorado Water Conservation Board under the provisions ofC.R.S. ~ ~ 37- <br />92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 0.8 efs (May 1 - <br />May 31); 0.35 cfs (June 1 - July 14); 0.25 (July 15 - October 31); and 0.35 (November I <br />- April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 0.8 cfs <br />(May 1 - May 31); 0.35 cfs (June 1 - July 14); 0.25 (July 15 - October 31); and 0.35 <br />(November I - April 30) is hereby entered to preserve the natural environment to a <br />reasonable degree through the stream segment described in paragraph 4 above. The <br />appropriation date for this water right is January 22, 2003. <br /> <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling. The Applicant shall install and maintain such <br />measuring devices and keep such records as the Division Engineer may require for <br />administration of this right. <br /> <br />2 <br /> <br />j <br />
