Legal description of the stream segment through which <br />,an instream flow is claimed. <br /> <br />The natural stream channel from the headwa- <br />ters in the vicinity of latitude 38004'25"N <br />and longitude 105038'32"W as the upstream <br />terminus and extending in the vicinity of <br />latitude 37059'25"N and longitude 105042'24"W <br />as the downstream terminus, being a distance <br />of approximately 7.4 miles. This segment can <br />be located on the Rito Alto Peak and Crestone <br />U.S.G.S. quadrangles, <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U.S.G.S. and/or <br />U.S.F.S, mapping is as follows: upstream <br />terminus in the NW/4 SE/4, Sec. 10, T44N, <br />R12E, N.M.P.M.; downstream terminus in the <br />SW/4 SE/4, See, 12, T43N, R11E, N,M.P.M, <br /> <br />5. Use of the water: <br /> <br />Instream ,flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />6.5 c.f.s. (April 15 - August 31); 3.75 c.f.s.
