<br />I <br />t '. <br /> <br />.. <br />."u <br /> <br />.,.. <br /> <br />~ <br /> <br />~I1E~k~!lQ~_~~Q_!~~55~5~! <br /> <br />The Rio Grande Water Users Association (the "Water <br />Users") and tne Colorado water Conservation B03rd (the "board") <br />enter into the followin~ stipulation and agreement in <br />recognition of ~he need to integrate two goals of the State <br />of Colorado: (11 to provide flexibility in order to maximize <br />the beneficial use Colorado can make of the waters of the <br />Rio Grande available for use by Colorado under the Rio Grande <br />Compact and (ZI the establishment and exercise of water <br />right5 obtained for the pJrpose of preserving the natural <br />environment to a reasonable degree. <br /> <br />RECITALS <br />-------- <br /> <br />A. The ~IO Gr~nde ~ompact (the "co~Pdct"l. C.R.S. <br />1~7). 37-bb-1J1. imposes a duty on the State of Colorado to <br />d~llver water in the Rio Grande at the Colorado-New Mexico <br />state lin~. 'dministrati~n.of ~ater rights on the Rio ~rande <br />~dinstem in ~~lorddo to aiSJre compl iance ~ith,the compact <br />Oblig~tions has resulted in cJrtailments of div!rsions of I <br />water from the Rio Grande. and nas restricted the use of <br />various Rio Grande Reservoirs. <br /> <br />a. The Water users and the board recognize that <br />the State of Colorado has a conplex taSk in administering <br />the Rio Grande and its tributdries in order to meet the obli- <br />gations impose~ by the Lompact. This task is complicated <br />by the terms of the stay of proceedings in !~~~~_~ng_~~~ <br />~~~L~~_~~_~~1~[~12' 3?1 J.S. 901 (19b8). <br /> <br />C. In order to minimize the burdens of compact <br />administration. there is a need to retain flexibility con- <br />cerning the u.e of Rio Grande waters within Colorado. <br /> <br />D. Pursuant to C.R.S. 1973{ 37-92-102(3). as amended. <br />the board is vested With authority on behalf of th~'People <br />of the State ~f Colorado. to appropriate or acquire suCh <br />~aters of natural streams and lakes as may be required to <br />preserve the natJral environment to a reasonable degree. <br />The board established water rights (herein "said ~ater rights") <br />to preserve the natural environment to a reasonable degree <br />witn respect to certain streams in water ~ivision No. 3 <br />,"it~ an appropriation date of August lb. 198Z. <br /> <br />, <br /> <br />NOW. THEREFORE. in consideration of the foregoing. it <br />is agreed by and between the Water Jsers and the ~oard as <br />f:)ll o..s: <br /> <br />1.
