Based upon the affidavit of.James A. Willey (attached as Exhibit A and incorporated herein), <br />the Application For Storage Water Rights ofFairwayPines GolfPartners, Ltd. in Case No. <br />99CW222, and discussions with Water Conunissioner Eric Weig, the CWCB agrees that <br />Fairway Pines Golf Partners, Ltd.'s diversion' of water from wells tributary to the <br />Uncompahgre River (the FP Well Field and FP Well Nos, 1, 2, 3A, 4, 5A and 6) for storage <br />in the Fairway Pines Golf Course Ponds and use fot irrigation of the Fairway Pines Estates <br />Golf Course was a use of water in existence on the date the CWCB appropriated the iustream <br />flow water right applied for herein. The average annual diversions by those wells occurring <br />on the, date the CWCB appropriated the instream flow water right applied for herein did not <br />exceed 76.13 acre feet, with diversions not exceeding the following monthly amounts: <br />
