The name of the natural stream is: Uncompahgre River (instream flow), <br /> <br />3. The source of the water is: The mainstem of the Uncompahgre River. <br /> <br />4. Legal description of the stream segment through which an instream flow is <br />claimed. <br /> <br />The natural stream channel from the Highway 62 bridge located in the SEl/4 <br />NW1/4, S16, T45N, R8W, NMPM as the upstream terminus and extending to the <br />Ridgway Reservoir in the NEI/4 NEI/4, S33, T46N, R8W, NMPM as the <br />downstream terminus, being a distance of approximately 4 miles. This segment <br />can be located on the Ridgway and Dallas U.S.G.S. quadrangles. See Exhibit A. <br /> <br />5. Use of water: Instream flow to preserve the natural environment to a reasonable <br />degree, <br /> <br />6. <br /> <br />Date ofinitiation of appropriation: July 13, 1998 <br /> <br />..... <br /> <br />7. The water was. first applied to the above beneficial use on July 13, 1998, by action <br />of the Colorado Water Conservation Board under the provision ofC.R.S. g g 37- <br />92-102(3),37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed: (ABSOLUTE): Instream flow of 65,0 c.f,s. (May 1 - <br />October 14); 20.0 c.f.s. (October 15 - April 30). <br /> <br />9. Proposed terms and conditions: <br /> <br />Pursuant to section 37-92-102(3)(b) and to the Applicant's stipulations with <br />Objectors Fairway Pines Golf Partners, Ltd. and the Dallas Creek Water <br />Company, the instream flow water right decreed herein shall be subject to those <br />Objectors' diversion of water from the FP Well Field and FP Well Nos. 1,2,4 <br />and 6, which wells are tributary to the Uncompahgre River, pursuant to the decree <br />entered in Case Nos. nCWI77 and nCWI78, for storage in the Fairway Pines <br />Golf Course Ponds 2, 3 and 4 and use for irrigation of the Fairway Pines Estates <br />Golf Course, which was a use of water in existence on the date the Applicant <br />appropriated the subject instream flow water right.
