STIPULATION

COME NOW the United States of America, by its attol'neys,

and the Applicant, Colorado W~t~r Conservation Board, by and
through its attorneys, and he~eby stipulate and agree as follows:

1. The inclusion of \he following provisions in the
Referee's ruling and decree .<?~ -Co~rt entered thereon will prote'ct
the interests of the United S~~tes of America:

a. Applicant's rights are subject to all senior

subject source, including properly decreed
reserved rlght~', as are now or will hereafter
be determined by law.

or rights-of-way, as the case may be, if the

same are requi,red by law for the use of public
resources contemplated by the subject application
