The natural stream channel from headwaters in the vicinity of latitude 380 07' 00" N and longitude 1070 11' 38" W as the upstream terminus and extending to confluence East Fork Powderhom Creek in SW \I.i NW \I.i, Sec. 21, T46N, R2W, NMPM as the downstream terminus, being a distance of approximately 10.6 miles. this segment can be located on the Powderhom Lakes, and Rudolph Hill U.S.G.S. quadrangles. See Exhibit A. 5. Use of water: To preserve the natural environment to a reasonable degree 6. Date of initiation ofappropriation: January 29,1998 7. The water was first applied to the above beneficial use on January 29, 1998, by action of the Colorado Water Conservation Board under the provision ofC.R.S. 99 37-92-102(3),37-92-103(3), (4), (10). 8. Ami)unt of water claimed (ABSOLUTE): Instream flow of 1.50 c.f.s. (April 1 - October 31); 0.75 c.f.s. (November 1 - March 31). THE W ATI8:R REFEREE RULES: The application is granted and a decree in the amount of (ABSOLUTE) Instream flow of 1.50 c,r.s. (April 1 - October 31); 0.75 c.f.s. (November 1 - March 31) is hereby entered to preserve the natural environment to a reasonable degree through the upstream and downstream points as described in paragraph 4 above. The appropriation date for this waterright is January 29,1998 The priority herein awarded was flied in the water court in the year of 1998 and shall be junior to all priorities filed in previous years. As between all rights flied in the same i;alendar year, priorities shall be determined by historical date of appropriation and not affected by the date of entry of ruling. The Applicant shall install and maintain such measuring devices and keep such records as the Division Engineer may require for administration of this right. It is ORllERED that this Ruling shall be f1!ed with the water clerk subject to judicial review. 2
