<br />. <br /> <br />. <br /> <br />DISTRICT COURT, WATER DIVISION 5, COLORADO <br /> <br />Case No. 90CW283 <br /> <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING AND DECREE <br /> <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE <br />COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE <br />PEOPLE OF THE STATE OF COLORADO, <br /> <br />IN IRON CREEK, A NATURAL STREAM, <br /> <br />IN THE WATERSHED OF THE COLORADO RIVER <br /> <br />IN GRAND COUNTY, COLORADO. <br /> <br />This matter comes before the Referee on the Application <br />for Water Rights of the Colorado Water Conservation Board <br />(CWCB) to grant its Application for an instream flow water <br />right in Iron Creek. <br /> <br />The Referee has reviewed the Application, has reviewed <br />all other pleadings in the file, has made such investigations <br />as are necessary to determine whether the statements in the <br />Application are true, and as a result is fully advised in the <br />premises, and does hereby enter the following Ruling: <br /> <br />FINDINGS OF FACT <br /> <br />1. Historv of the proceedinqs: <br /> <br />a. Notice and Jurisdiction: The CWCB filed the <br />above entitled Application with the Court on <br />December 28, 1990. The case was referred to the <br />Water Referee for Water Division No. 5 in <br />accordance with the provisions of C.R.S. ~ 37-92- <br />101, et seq. (1990 Repl. Vol. 15). <br /> <br />Timely and adequate notice of this proceeding has <br />been given in the manner required by law. The <br />Court has jurisdiction over the subject matter of <br />
