STIPULATION

COME NOW the United States of America, by its attOl'neys,

and the Applicant, Colorado W~ter Conservation Board, by and
through '~ts attorneys, and hereby stipulate and agree as follows:
1. The inclu~ion of the following provisions in the

Referee's ruling and decree of Court entered thereon ~ill protect

th~ interests of the United States of America:

a. Applicant's rights are subject to all senior

rights of the United States of America in the

reserved rights, as are now or will hereafter

be determined by law.
,b. Applicant shall apply for any special use permits
or rights-of-way, as the case may be, if the
