Legal description of the stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel from the outlet of the St John Reservoir at <br />latitude 390 19' OO"N and longitude 1070 09' 46"W as the upstream <br />tenninus and extending to the headgate of the Lewis Ditch at latitude 390 <br />20' 05''N and longitude I 070 11' 03"W as the downstream tenninus, being <br />a distance of approximately 1.8 miles. This segment can be located on the <br />Mount Sopris U.S.G.s. quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus = SE NE SEC 36 TWN 8S RNG 88W 6PM <br />590' West of East Section Line & 2580' South of North Section Line <br />UTM43 53 935N 13 313 561E <br />Lower Tenninus = NW NE SEC 26 TWN 8S RNG 88W 6PM <br />1360' West of East Section Line & 1130' South of North Section Line <br />UTM 43 55 988N 13 3 I] 749E <br /> <br />5. Use of the water: <br />Instream flow to preserve thc natural enviromnent to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 22, 2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action of the Colorado Water Conservation Board under the provisions ofC.R.S. ~ ~ 37- <br />92-102(3) and 37-92-103(3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLtJTE); Instream flow of 1.5 cfs (May 1 - July <br />31) and 0.5 cfs (August 1 - April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.5 cfs <br />(May 1 - July 31) and 0.5 cfs (August I - April 30) is hereby entered to preserve the natural <br />environment to a reasonable degree through the stream segment described in paragraph 4 <br />above. The appropriation date for this water right is January 22, 2003. <br /> <br />Thc priority herein awarded was f1\ed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br /> <br />2 <br />
