FINDINGS OF FACT

1. An Application for Water Rights to Protect the Natural Environment to a Reasonable
Degree was filed on December 31,1998.

2. The Water Clerk caused publication of such filing as provided by statute; that the
time for filing Statements of Opposition expired on the last day of February 1999, and
none have been filed.

3. The Application concerns a claim for an instream flow in Little High Creek located in
Teller and Fremont Counties, Colorado, to protect the natural environment to a
reasonable degree.

4. The Division Engineer has filed his Consultation Report dated May 13, 1999,
pursuant to C.R.S. 37-92-302(4), and the Referee has given it due consideration.

5. The Applicant has furnished acceptable proofas to claims made.

IT IS, THEREFORE, ORDERED AS FOLLOWS: The Applicant be, and is
hereby, awarded an instream flow water right, to-wit:
