Consultation on March 31, 1988 recommending that
approval be granted for the Application.

d. This matter was initially referred to the Water
Referee for Water Division 1 for consideration
pursuant to S 37-92-203(7), 15 C.R.S. (1990). On
September 14, 1993, DY Order of the Referee entered
pursuant to S 37-92-303(2), 15 C.R.S. (1990), the
Application was re-referred to the Water Judge for
Water Division 1.

e. CWCB and Longmont have entered into a Stipulation
dated April 6, 1995, the terms of which are
incorporated herein by reference.

4. Requested Water Right: The CWCB appropriated the
Instream Flow more fully described as follows:

a. The source of the water is South St. vrain Creek,
tributary to st. Vrain Creek.

b. Location:

Legal description of the stream segment through which
an Instream Flow is claimed: The natural stream
channel from the confluence with Middle St. vrain Creek
at lat. 40 deg. 10'03"N, long. 105 deg. 23'46"W as the
upstream terminus and extending to the headgate of the
Longmont Diversion in the SEj4 NWj4sec. 19 T3N R70W
6th P.M. as the downstream terminus being a distance of
approximately 9.1 miles. This segment can be located
on the Raymond and Lyons U.S.G.S.quadrangle(s).

Administration: For the stream segment(s) in an
unsurveyed area, the Division Engineer has determined
for administrative purposes that the approximate legal
description of the Instream Flow termini as protracted
from U.S.G.S. mapping is as follows: upstream terminus
in the NEj4 sec. 1 T2N R72W 6th P.M.

c. Use of the water: For Instream Flows to preserve
the natural environment to a reasonable degree.

d. Date of appropriation: December 11, 1987. The
appropriation was initiated and water first put to a
beneficial use on December 11, 1987, by action of the
Colorado Water Conservation Board under Sections 37-92-
102(3), 37-92-103(3), 37-92-103(4), and 37-92-103(10),
15 C.R.S. (1990).
