Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from Dead Horse <br />Spring in the vicinity of latitude 390 39' <br />25" N and longitude 1070 13' 15" W as the <br />upstream terminus and extending to the con- <br />fluence of East Fork Dead Horse Creek in the <br />NE/4 SW/4, Sec. 19, T5S, R87W, 6th P.M. as <br />the downstream terminus, being a distance of <br />approximately 5.2 miles. This segment can be <br />located on the Broken ~ib Creek and Shoshone <br />U.S.G.S. quadrangles and is depicted on Ex- <br />hibit A. <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Eng~neer has determined <br />for administrative pUrIloses that the approxi- <br />mate legal description of the instream flow <br />termini as protracted trom U.S.G.S. and/or <br />U.S.F.S. mapping is as follows: upstream <br />terminus in the NW/4 SW/4, Sec. 36, T4S, <br />R88W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to prese~ve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of QPpropriation: <br /> <br />November 26, 1996. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 26, 1996, by action of the Colorado Water Conserva- <br />tion Board pursuant to the provi~ions of ~~ 37-92-102(3), and <br />37-92-103 (3), (4), and (10), 15 C.R.S. (1990 Repl. VoL), and <br />~ 37-92-102(4), 15 C.R.S. (1996 Supp.). <br /> <br />8.
