W as the upstream terminius and confluence Park Creek at
lat. 37 deg. 31'44" N. long. l06 deg. 42'00" W as the down-
stream terminus. being a distance of approximately 2.3 miles.
This segment can be located on the Beaver Creek Res. U.S.G.S.
quadrangle.

d. There is no means of diversion. the claim
being to a minimum stream flow of 2 cubic feet/second of
water per second of time. in place in the stream bed.

e. The date of initiation of such appropria-
tion pursuant to the action of applicant under the provision
of C.R.S. 1973. 37-92-102(3). and 37-92-103(3). (4) and
(10) is July 8. 1980. on which date the water of said stream
was first applied to beneficial use to maintain the minimum
stream flow required to preserve the natural environment to
a reasonable degree.

THEREFORE. IT IS RULEO AND ORDERED that the application
herein be and it is hereby granted. and that applicant is
awarded an absolute in place minimum stream flow water right
for 2 cubic feet/foot of water per second of time in Kelly
Creek. with a priority date of July 8. 1980 for the purpose
of maintaining the minimum stream flow as required to pre-
serve the natural environment to a reasonable degree. uncon-
ditionally. subject. however. to all priority rights of
senior appropriators of water in the affected watershed.
