There is no point of diversion as such, <br />and none is claimed. The minimum stream flow right claimed <br />is in the watershed of the Rio Grande. from its headwaters <br />in vicinity of lat. 37 deg. 27'19" N long. 106 deg. 42'48" <br />W as the upstream terminus and confluence South Fork Rio <br />Grande at lat 37 deg. 33'10" N. long. 106 deg. 46'38" W as <br />the downstream terminus. being a distance of approximately <br />9.2 miles. This segment can be located on the Spar City <br />15;, Wolf Creek Pass 15; Elwood Pass U.S.G.S. quadrangle. <br /> <br />d. There is no means of diversion, the claim <br />being to a minimum stream flow of (S-May 1 thru Sept. 30; <br />W-Oct 1 thru April 30) S-9. W-~ cubic feet/second of water <br />per second of time. in place in the stream bed. <br /> <br />e. The date of initiation of such appropria- <br />tion pursuant to the action of ap~licant under the provision <br />of C.R.S. 1973, 37-92-102(3), and 37-92-103(3), (4) and <br />(10) is July 8. 1980, on whiCh date the water of said stream <br />was first applied to beneficial use to maintain the minimum <br />stream flow required to preserve the natural environment to <br />a reasonable degree. <br /> <br />f. That appl icant is entitled to an absolute <br />in place minImum stream flow water right for such beneficial <br />use with a priority date of July 8. 1980. <br /> <br />THEREFORE, IT IS RULEO AND ORDERED that the application <br />herein be and it is hereby granted. and that applicant is <br />awarded an absolute in place minimum stream flow water right <br />for 59, W5 cubic feet/foot of water per second of time in <br />Pass Creek, with a priority date of July 8. 1980 for the pur- <br />pose of maintaining the minimum stream flow as required to <br />preserve the natural environment to a reasonable degree. <br />unconditionally. subject. however, to all priority rights <br />of senior appropriators of water in the affected watershed. <br /> <br />-2- <br /> <br />..~".r~ <br />
