~

.

.

ing of statements of Opposition in Water Court
{537-92-302(1)(b), C.R.S. (1990 Repl. Vol.)} do not ap-
ply to the Objectors' rights to sell their lands and/or
water rights unless the sale involves a change of water
rights Application filed with the Water Court.

To resolve the Objectors' concerns with the Application
filed in this case, the parties have agreed that in the event the
CWCB acquires water rights which are senior in priority to the
water rights owned by the Objectors at that time anQ which are
located in the instream flow reached described in the Application
filed in this case, the CWCB wculd be required under the current
statutes to file an application to change the use of the acquired
water rights with the Water Court. Once a change of use Applica-
tion is filed with the water Ccurt, the current provisions of
537-92-302(1) (b) would allow the Objectors to file Statements,
of Opposition to any proposed Qhange which the Objectors believe
may injure their water rights.

The Referee has made such investigations as are necessary
to determine whether or not th~ statements in the A~plication are
true and has become fully advi~ed with respect to the subject
matter of the Application. Th~ Referee has spoken to the remain-
ing Objector, Ted Myers, conce~ning Mr. Myers' objection to this
Application. The Referee has ~equested that Mr. Myers submit his
concerns that members of the pqblic not gain a right to trespass
on his property to gain access to the instream flow in writing to
the Referee. Mr. Myers has fatled to comply with the Referee's ,
request.

IT IS HEREBY THE RULING OF THE WATER REFEREE:

1. The name and address of the Applicant are:

Colorado Water Conservation Board
1313 Sherman Street, suite 721
Denver, CO 80203
(303) B66-344l

2.
