<br />2. <br /> <br />The name of stream involved: <br />Cottonwood Creek (instream flow) <br /> <br />3. <br /> <br />The source of the water is: Cottonwood Creek <br /> <br />4. <br />claimed: <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />a. The natural stream channel from the confluence of the Little <br />Cottonwood Creek at latitude 380 16' IS" N and longitude 1080 21' <br />OS" W as the upstream terminus and extending to the confluence of <br />San Miguel River at latitude 380 16' 06" N and longitude 108024' 04" <br />W as the downstream terminus, being a distance of approximately 3.2 <br />miles. This segment can be located on the Big Bucktail Creek and Ute <br />U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NW SW S6 RI3W T46N PM <br />77' East of West Section Line 1619' South of North Section Line <br />UTM 4241175 N 206794 E <br />Lower Terminus = NE SW S3 RI4 W T46N PM <br />1720' East of West Section Line 2283' North of South Section Line <br />UTM 4241059 N 202442 E <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural envirorunent to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />S S 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of3.0 cfs (Apr. I - <br />June IS). <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 3.0 cfs <br />(Apr. I - June IS) is hereby entered to preserve the natural envirorunent to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling.
