<br />.r' -~. <br /> <br />No, 98 CW 465 <br /> <br />3. <br /> <br />The source of the water is: <br />Nott Creek, tributary to Clear Creek. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />The natural stream channel from the headwaters in the NW NW, Sec. 24, TIS, <br />R72W, 6th P.M, 260 feet east of the west section line of section 24 and <br />480 feet south of the north section line of section 24 as the upstream terminus and <br />extending to the confluence of Ralston Creek in the NW SE, Sec. 29, T2S, R71 W, <br />6th P.M, 2430 feet North of the South Section line of section 29 and 2100 feet <br />west of the East section line of section 29 as the downstream terminus, being a <br />distance of approximately 3.2 miles. This segment can be located on the Blackhawk <br />and Ralston Buttes U.S.G.S. quadrangles as depicted on Exhibit A. <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 29,1998. <br /> <br />7. The water was fi~st applied to the above beneficial use on January 29, 1998, by , <br />action of the Colorado Water Conservation Board under the provision of c.R.S. S 37-92-102(3), ' <br />37-92-103(3 ),(4),(10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 1.00 c.f.s. (April 15 - <br />July 14); 0.50 c.f.s. (July 15 - August 14); 0.20 c.f.s. (August 15 - ApriI14). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.00 c.f.s. (April <br />15 - July 14); 0.50 c.f.s. (July 15 - August 14); 0.20 c.f.s. (August 15 - April 14) is hereby entered <br />to preserVe the natUral environment to a reasonable degree through the upstream and' downstream <br />points as described in paragraph 4 above. The appropriation date for this water right is January <br />29, 1998. <br /> <br />The priority herein awarded was filed in the water court in the year of 1998 and shall be <br />junior to all priorities filed in previous years. As between all rights filed in the same calendar <br />year, priorities shall be determined by historical date of appropriation and not affected by the <br /> <br />2 <br />
