<br />. <br /> <br />. <br /> <br />. <br /> <br />, <br /> <br />Administration: For the stream segments in an unsurveyed <br />area, the Division Engineer has determined for administrative <br />purposes that the approximate legal description of the upstream <br />and downstream points of the instream flow reach as protracted <br />from U.S.G.S. mapping is as follows: upstream point in the SE/4 <br />SE/4 56 T2S R76W 6PM; downstream point in the SW/4 SE/4 S4 T2S <br />R76W 6PM. <br /> <br />5. Use of the water is for instream flows to preserve the <br />natural environment to a reasonable degree. <br /> <br />6. The date of initiation of appropriation is November 27, <br /> <br />1990. <br /> <br />7. The amount of water claimed is: 0.5 c.f.s. (April 15 - <br />August 31); 0.25 c.f.s. (September 1 - April 14), both absolute. <br /> <br />8. The water was first applied to the above beneficial use <br />on November 27, 1990, by action of the Colorado Water Conserva- <br />tion Board under the provisions of C.R.S. 37-92-102(3), <br />37-92-103 (3), (4), (10). <br /> <br />The Referee rules that this application should be granted, <br />and an absolute decree for 0.5 c.f.s. (April 15 - August 31); <br />0.25 c.f.s. (September 1 - April 14), is hereby awarded for the <br />purpose of maintaining an instream flow to preserve the natural <br />environment to a reasonable degree on Deadhorse Creek between the <br />upstream and downstream points as described in paragraph 4 above, <br />with an appropriation date of November 27, 1990. The Applicant <br />shall install and maintain such measuring devices and maintain <br />such records as the Division Engineer may require for administra- <br />tion of this right. <br /> <br />It is accordingly ORDERED that this Ruling shall be filed <br />with the Water Clerk subject to Judicial review. <br /> <br />It is further ORDERED that a copy of this Ruling shall be <br />filed with the Division 5 Engineer and the State Engineer. <br /> <br />DATED this ;2 q day of ~tfti;tL4, <br /> <br />1991. <br /> <br />BY THE REFEREE: <br /> <br />Rav Walker <br /> <br />Ray Walker, P.E. <br />Water Referee <br /> <br />-2- <br />
