The natural stream channel from the headwaters of the North Fork of the Smith Fork at latitude 380 43' 54" N and longitude 107023' 15" W as the upstream terminus and extending to the confluence of the South Fork of the Smith Fork at latitude 380 43' 31" N and longitude 1070 28' 23" W as the downstream terminus, being a distance of approximately 9.4 miles. This segment can be located on the Mount Guero U.S.G.S. quadrangles. b. For administrative purposes only: Upper Terminus = NW SW S19 T15S R89W 6PM 374 feet East of West Section Line 1973 feet North of South Section Line UTM 4289716N 0292459E Lower Terminus = NE NW S29 T15S R90W 6PM UTM 4289188N 0285022E 5. Use ofthe water: Instream flow to preserve the natural environment to a reasonable degree. 6. Date of initiation of appropriation: January 25, 2005. 7. The water was first applied to the above beneficial use on January 25, 2005, by the action of the Colorado Water Conservation Board under the provisions of c.R.S. ~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). 8. Amount of water claimed (ABSOLUTE): Instream flow of 3.5 cfs (Feb. 15 - Mar. 31),6.8 cfs (Apr. 1 - July 31), 3.5 cfs (Aug. 1 - Nov. 14), and 3.0 cfs (Nov. 15 - Feb. 14). THE WATER REFEREE RULES: The application is granted and a decree (ABSOLUTE) in the amount of3.5 cfs (Feb. 15 - Mar. 31), 6.8 cfs (Apr. 1 - July 31),3.5 cfs (Aug. 1 - Nov. 14), and 3.0 cfs (Nov. 15 - Feb. 14) is hereby entered to preserve the natural environment to a reasonable degree through the stream segment described in paragraph 4 above. The appropriation date for this water right is January 25, 2005.
