Legal description of the stream segment through which an instream flow is claimed <br /> <br />a. The natural stream channel from the headwaters of the North Fork of <br />the Smith Fork at latitude 380 43' 54" N and longitude 107023' 15" W <br />as the upstream terminus and extending to the confluence of the South <br />Fork of the Smith Fork at latitude 380 43' 31" N and longitude 1070 <br />28' 23" W as the downstream terminus, being a distance of <br />approximately 9.4 miles. This segment can be located on the Mount <br />Guero U.S.G.S. quadrangles. <br /> <br />b. For administrative purposes only: <br />Upper Terminus = <br />NW SW S19 T15S R89W 6PM <br />374 feet East of West Section Line 1973 feet North of South Section <br />Line <br />UTM 4289716N 0292459E <br />Lower Terminus = <br />NE NW S29 T15S R90W 6PM <br />UTM 4289188N 0285022E <br /> <br />5. Use ofthe water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of c.R.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 3.5 cfs (Feb. 15 <br />- Mar. 31),6.8 cfs (Apr. 1 - July 31), 3.5 cfs (Aug. 1 - Nov. 14), and 3.0 cfs (Nov. 15 - <br />Feb. 14). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of3.5 cfs <br />(Feb. 15 - Mar. 31), 6.8 cfs (Apr. 1 - July 31),3.5 cfs (Aug. 1 - Nov. 14), and 3.0 cfs <br />(Nov. 15 - Feb. 14) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br />
